Legal Definition

Attorneys must file certificates in cases involving (1) professional malpractice (the attorney must certify he consulted with an expert and thus believes the action is meritorious), and (2) the enforcement of CC&Rs (covenants, conditions, and restrictions). Failure to file certificates in these cases are grounds for a special demurrer.
