Contracts β’ Performance Under UCC
K#112
Legal Definition
A buyer's ability to reject is limited by: (1) the seller's ability to cure; (2) the fact that it is an installment contract; or (3) acceptance.
Plain English Explanation
A buyer may not be able to reject the delivery of goods if: (1) the reason they want to reject the goods is due to defect, however, the terms of the agreement give the seller a right to try to fix the problem first; (2) the goods are being delivered as part of an installment contract, which means there will be further deliveries and opportunities to make things right; or (3) the buyer has already accepted the goods (i.e., no taksies-backsies).
