Legal Definition

Wrongful Death Acts grant recovery for financial injuries endured by the spouse and next of kin. Recovery is only allowed to the extent that the deceased may have recovered had they lived.

Plain English Explanation

We exist in a society where it is common for people to live with their families and structure their lives in ways where some people in the family work to bring in money, and others work to maintain the household, or even just enjoy the luxury of having shelter. When someone causes the death of another person, the victim's surviving family has a right to be compensated for the pain associated with losing a loved one, as well as the loss of income that would have otherwise been generated if the victim were still alive and working.

In other words, Wrongful Death Acts create a legal right for people to recover for the emotional and economic harm caused by the death of their loved one.
