Criminal Law • Crimes Against Property
CRIMLAW#047
Legal Definition
Receipt of stolen property is receiving possession and control of stolen personal property known to have been obtained in a criminal way by another person with the intent to permanently deprive the victim of their interest.
Plain English Explanation
"Receipt of stolen property" means that a person has taken possession or control over property that they know—or should have known—was stolen from someone else. Sometimes it can be as explicit as a defendant objectively knowing they are taking possession of stolen property (because they either witnessed the theft or are aware that the person is a criminal who engages in theft), or it can be implicit, like when someone approaches you in a parking lot and offers to sell you a high-end stereo system for a suspiciously low price.
