Real Property • Easements
PROP#115
Legal Definition
An easement owner has the power to release the servient owner, so long as the release contains all the formalities required for a valid creation of an easement.
Plain English Explanation
The person who holds the easement can "release" the servient estate from its burden by conveying the easement to them. Similar to destroying an easement by merger, once the burdened estate holder also holds the easement, the easement is extinguished.
