Legal Definition

Unlike the ABA, California rules do not explicitly interfere with these types of client transactions. However, California case law discourages contracts before the end of proceedings but tolerates them if the judge is satisfied that the client clearly understands and consents.

Plain English Explanation

Unlike the ABA which very clearly says, "You may not try to buy a client's media rights until you're done representing them," in California, home to Hollywood, things are a bit more lenient. Though it's still not encouraged for lawyers to try to buy their clients' story rights until after they finish representing them, the California Rules will allow it to happen as long as a judge signs off that the client wasn't taken advantage of.
